Manuel Sarmiento focuses his legal practice in the areas of construction litigation, insurance law, and commercial disputes. He has experience representing landowners, contractors, subcontractors, and suppliers concerning disputes that arise in the construction of residential, commercial, and public projects, including claims of construction defects, defective design, breach of warranty, delay, and loss of productivity. Manuel also has experience representing contractors in employment discrimination claims as well as real estate entrepreneurs in claims against their brokers for breaching their fiduciary duties.

Manuel brings his prior experience as a lawyer for a firm that specialized in construction law. Previously, Manuel clerked for three US District Court judges in Puerto Rico, where he was born and raised. He aided the Court in all types of civil and criminal cases such as construction litigation, commercial disputes, insurance law, employment discrimination, prisoner petitions, RICO, trials, and arbitration. During law school, he was an SJC Certified Rule 3:03 Student Prosecutor with the Suffolk County District Court’s Appeals Division as well as in the South Boston District Court, where he gained significant trial and appellate experience.

  • Represented construction contractors asserting motions for summary judgment under the Massachusetts Prompt Payment Act and the Retainage Act in private projects with a contract price of over 3 million dollars (2024). 
  • Defended asbestos abatement and demolition contractor against defective workmanship claims in a residential project (2024).
  • Successful prosecution of private care providers on behalf of contractors in connection with nonpayment of construction services (2024).
  • Represented condominium association in construction dispute against the developers, general contractor, architect, and supervisors concerning systemic water leaks in brand-new condominium (2024).
  • Represented subcontractor to assert claims of racial discrimination and retaliation against the general contractor arising from projects that received federal financial assistance (2024).
  • Defended roofing contractor against claims of contribution, indemnification, and breach of warranty that were brought past the statute of limitations deadline (2023). 
  • Represented landowner in a construction dispute against his neighbor and the Town when they destroyed his mutually shared pond (2023).
  • Represented condominium owner in a real estate dispute against his broker and salesperson concerning conflicts-of-interest violations (2023).
