Charbel has extensive experience in mixed use developments and has advised large local and international developers in Kingdom of Saudi Arabia on the process of subdividing, titling, homeowners associations, and master community declarations.

He acts for a wide range of clients in matters related to drafting asset management agreements, development management agreements, facility management agreement, reviewing and negotiating hotel management agreements and ancillary documentation. 

Expérience

• Assisted clients on their acquisition of real estate, by conducting due diligence (including reviewing property title deeds, license), advising on all legal aspects of the transaction, drafting the relevant documentation (i.e. sale and purchase agreement, due diligence report, corporate authorizations, and red flag issues report etc.).
• Preparing memoranda of legal advice on various matters (i.e., titling, subdivision, expropriation, ease structures in compliance with Ejar  etc.).
• Prepared and negotiated commercial lease agreements for multiple types of business.
• Advised local and international clients on the subdivision of large mix used developments according to the Joint Owned Property Regulations and subdivision procedures set by the Units Subdivision Department in the Ministry of Rural Affairs and Housing.
• Drafted master community declarations to govern the overall administration and operation of the master community, including the owners’ and occupiers’ use of the common use areas of the master community and assisted in submitted such documentation to the Real Estate General Authority.
• Assisted clients in acquiring off-plan sales and rent licenses from WAFI.
• Assisted clients n acquiring developer license from Itmam.
• Assisted clients in acquiring Ejar licenses from Ejar.
• Advised developers across KSA on hotel management agreements and the ancillary documentation related to international brands.
• Advised international hotel operators on their template hotel management agreement according to KSA laws and regulations.
• Advised local and international clients on branded residences and its implementation according the Saudi Joint Owned Property Law.
