Based in our Madrid office, Hilda is an Associate in the Casualty and Healthcare team, specialising in personal injury claims.
She regularly deals with sensitive matters of significant value in cross border, international and national claims of different nature including aviation accidents, motor, public liability, employers’ liability and medical liability. She is a specialist in valuation of personal injuries under Spanish Law and has drafted affidavits on Spanish Law to be presented as evidence in judicial proceedings in the UK and Italy. She regularly provides legal advice on issues of jurisdiction and applicable law, liability, quantum and policy coverage.
Hilda has wide expertise in dealing with claims related to significant spinal injuries, brain injuries, serious orthopaedic injuries, serious aesthetic damage and fatal accidents. Hilda focuses on personal injuries and international claims, in particular regarding to hotel chains and tour operators. Her practice also includes aviation, road accidents and shipping.
She also has a broad experience in attending Courts in Spain and leading negotiations.
Hilda has a double degree in Law and Political Science at Universidad Pontificia de Comillas (ICADE) in Madrid. Before joining Clyde & Co, she studied an LLM in Medical Law at Queen Mary University in London. She speaks both English and German.
Expérience
- Settling a severe brain injury claim pursued in the UK, saving the Insurer almost £7 million by alleging arguments based on jurisdiction, applicable law, causation and liability.
- Managing to settle several claims derived from an aviation accident in accordance with the Spanish Baremo although there is limited case law that applies the Spanish Baremo in aviation accidents.
- Successfully negotiating several cross-border claims pursued by citizens of different countries who suffered a road traffic accident in Spain, avoiding the application of foreign law which resulted in significant saving for the Insurer.
- Representing a major international insurer in a salmonella outbreak in Spain and managed to settle all the claims pursued under Spanish Law without the instigation of legal proceedings.
- Successfully achieving significant discounts for contributory negligence on three overseas spinal injury claims related to a cycling accident, a pedestrian accident and an accident in a waterpark.
- Successfully dealing with different personal injury claims in Spanish Courts.
- Providing legal advice to Insurers on the content of the Spanish Baremo and its limitations.
