Nick Benson is a Senior Associate in the London office specialising in D&O liability, brokers’ errors and omissions, and exposures of property professionals.

Nick is a Senior Associate in the Insurance, Financial and Professional Disputes team in our London office.

Nick acts principally for London Market insurers and their insureds on the coverage and defence aspects of D&O liability disputes, insurance brokers’ errors & omissions, and property professionals’ exposure. In doing so, this encompasses both direct insurance and reinsurance arrangements, as well as operating as monitoring counsel in respect of overseas claims.

On D&O matters, Nick’s advice has spanned a wide variety of civil claims stemming from alleged breaches of directors’ duties, as well as insolvency-driven action and regulatory investigations into a diverse range of corporate entities, including SMEs, charities, private and listed companies.

On professional negligence matters, Nick has dealt with claims emanating from both domestic retail broker disputes and complex Lloyd’s broker placements (the latter of which often encompasses a multijurisdictional focus whether by virtue of the underlying litigation being pursued internationally, and/or the insurance risk being located abroad). Moreover, Nick also acts for one of the leading property consultancy firms in the UK and their insurers, dealing with an eclectic suite of claims arising from the provision of estate agency, lettings, valuation and consultancy services.

Expérience
  • Acted as coverage counsel on a D&O claim made by a large offshore operator of casino resorts in relation to a USD1 billion litigation in Macau, Japan and Nevada.
  • Acted for leading Lloyd’s broker in respect of its exposure to a USD2 billion class action emanating from the binding of a visual arts policy for a critically-acclaimed film.
  • Defended a national firm of property consultants and their insurers in relation to advice provided on a £60m agricultural land development.
  • Acted as coverage counsel for insurers of a South African pension adviser involving issues of Enhanced Transfer Value business activities and a s.166 FSMA investigation.
  • Defended the director/founder of a tech start-up in relation to a seven-figure claim brought by shareholders and a fellow director in an attempt to seize control of the company.
  • Defended claims against Lloyd’s brokers for COVID-associated losses suffered by a number of high-profile music artists, promoters and festivals both domestically and abroad.
