The United Arab Emirates has recently strengthened its approach to combatting terrorism through the implementation of comprehensive legislative reforms. These initiatives are designed to rigorously address the promotion of terrorism and related activities, underscoring the nation’s dedication to preserving security and stability. The amendment of Federal Law No. 7 of 2014 on combatting terrorism offences, alongside amendments to Federal Decree Law No. 34 of 2021 signals a definitive stance: any endorsement or support of terrorism within the UAE will incur severe penalties.
The introduction of Federal Law No. 4 of 2024 significantly strengthens the penalties outlined in Article 34 of the Federal Law No. 7 of 2014 on combatting terrorism offences. While the promotion of terrorist groups has always carried a penalty, the amendment broadens the scope and increases severity of penalties.
Previously, violators faced up to 10 years in prison for anyone who knowingly promoted any terrorist organisation, including the possession or publication of any promotional materials for distribution. Now, under the new law, such actions could lead to life imprisonment.
Additionally, those found guilty will face hefty financial penalties ranging from AED 2 million to AED 4 million. This dual approach of severe imprisonment and substantial fines underscores the UAE's zero-tolerance policy towards terrorism.
In the digital age, the UAE has also turned its attention to the online sphere. Federal Law No. 5 of 2024 updates Federal Decree Law No. 34 of 2021, specifically targeting the online promotion of terrorism. Article 21 of the Decree Law now explicitly prohibits the creation or dissemination of content supporting terrorist groups through websites or any information technology platforms. This includes any efforts to recruit members, secure financing, or propagate terrorist ideologies.
The amendment maintains that the penalty for contraventions under the law shall be two-fold: a financial and administrative penalty. The financial penalty remains unchanged under the amendment, and ranges between AED 2 million to AED 4 million. The administrative penalties have, however, been significantly increased. Previously, violators faced 10 to 25 years in prison. Now, the law mandates life imprisonment for those found guilty, reflecting the grave nature of such offences.
