With over 15 years’ experience, Bradley’s primary area of focus is defending directors and officers in pre-claim and litigated disputes, and the balance of his practice is made up of defending professionals and advising insurers on complex coverage issues.
Bradley is highly experienced in handling disputes and advising on coverage issues. He has also supported clients with regulatory and whistleblower investigations, leveraging his technical knowledge to provide practical solutions.
He has worked with global insurers, London Market syndicates, and their insureds, gaining a deep technical understanding of their operations, which is crucial for swiftly assessing claims and implementing early resolution strategies.
Bradley has significant experience in litigated proceedings. He notably defended former directors of a failed company against shareholder actions for losses arising from their participation in private and public capital raisings.
Bradley has completed a secondment to our New York office, where he gained insights into bad faith claims, and a client secondment to the claims team of a leading insurer.
He is a member of the Institute of Directors and is admitted to practice in Australia. Bradley has worked on litigated claims across Australia, England & Wales, and the United States.
Experience
Management Liability:
Defended multiple directors against claims of fraudulent misrepresentation and/or misleading statements in a prospectus, brought under Section 90 of the Financial Services and Markets Act.
Defended an executive director against claims of insolvent trading.
Supported an aged care provider during a contaminated sites investigation.
Supported a high need care provider during a coronial inquiry into a death in care.
Professional Indemnity:
Supported a senior auditor investigated by the Financial Reporting Council following the collapse of a major British construction company.
Defended engineering firms against claims of negligent design of steelwork, ventilation, and footings.
Defended architecture firms against claims of negligent design of residential premises.
Defended medical professionals against claims of medical negligence, and in complaints to regulatory and disciplinary bodies.
Insurance Coverage:
Advised a reinsurer on a bad faith claim involving a primary insurer’s failure to settle a wrongful death claim, made in California, within policy limits.
Retained as coverage counsel in relation to the criminal investigation of an individual following a public inquiry into a mass fatality incident in the United Kingdom.
Advised a reinsurer on the operation of its policy and the fronting insurer’s primary policy, in the context of a mass fatality incident in Central Asia.
Commercial litigation:
Pursued subrogated recovery claims against at-fault parties to recover sums paid out to insured persons.
Defended an individual accused of fraud in connection with family business activities.
