Kim is a Legal Director based in the Manchester office within Clyde & Co’s top ranking personal injury defendant team.  She specialises in high value employers’ liability, public liability and road traffic accident claims, advising on policy, multi-party actions and complex liability disputes.  Kim has a particular interest in complex claims arising from road traffic accidents and has been involved in the successful defence of these claims with a particular interest in indemnity issues.

Kim works closely with both insurer and insured giving pragmatic and straightforward advice and has extensive experience of successfully running liability disputed claims to trial, often requiring exhaustive investigations with the insured and input from experts.

Kim also undertakes work for foreign insurers, which entails advising on prospects of pursuing a claim in the UK and jurisdictional issues. She has advised a Spanish Claimant who was involved in a road accident whilst on holiday in the UK and has dealt with a claim where an English Claimant sustained catastrophic injuries whilst on holiday in Monaco.

Her work encompasses serious injury and psychological conditions including chronic pain, amputations and fatal accidents.

Experience
  • Defence of a complex chronic pain case for an insurer client, securing a discontinuance a week before trial.
  • Defence at trial of a tripping accident for a national supermarket chain. The claim involved use of CCTV footage to undermine the accident circumstances leading to a successful defence.
  • Defence of a complex chronic pain case, securing a discontinuance 3 weeks before an 8 day trial with recovery of costs exceeding £70,000.
  • Discontinuance of a secondary victim claim following a fatal road traffic accident.
  • Successfully recovering a contribution of 75% against the manufacturers of a machine following an accident at work where the Claimant had suffered a traumatic amputation.
  • Providing regular training to insurers, including tailored case studies and workshops.
