Zbigniew Stasiak is a Counsel at Clyde & Co’s Warsaw office. He has been an active lawyer since 2004 and since 2008 he has been admitted to the Polish bar as a legal advisor (pl. radca prawny).

Between 2004 and 2010 he worked for a Polish energy regulator, i.e. the President of the Energy Regulatory Office in Poznań handling cases connected with i.e. licenses for energy business activities, imposing penalties on energy entrepreneurs, settling disputes between energy entrepreneurs and energy off-takers and representing the regulator before the courts.

In 2010 Zbigniew joined Dentons’ (then Salans) Warsaw office Energy and Natural Resources Practice where he worked until the end of 2023. His expertise encompasses a wide range of matters connected with regulatory issues in power, natural gas, liquid fuels and heat fields. Zbigniew also dealt with contractual and corporate matters related to commodity trading and regulatory duties of energy companies. He represented clients before regulatory and administrative bodies as well as before common and administrative courts, and the Polish Supreme Court in cases related to energy provisions. His client portfolio includes among others the biggest international and Polish commodity trading companies, and entities rendering power and gas distribution and transmission services.
 

Experience
  • Natural Gas Reserves – defending an international commodity trading company in the Polish courts against a Polish energy regulator demanding a fine for allegedly non-compliance duties to keep natural gas reserves.
  • Commercial Disputes – advising a Polish power company in a dispute against an international multi-energy company concerning anti-competitive actions on the Polish power distribution services market.
  • Commercial Disputes – advising and representing an international automotive company in the proceedings connected with improper settlements under a power supplies agreement. 
  • Natural Gas Tariffs – Advising and representing a Polish natural gas transmission company in a set of cases concerning excessive tariff prices.
  • Commercial Contracts – advising an international commodity trader in concluding contracts for sale and transport of LNG from a Polish LNG Terminal in Świnoujście to a network of fuel stations in Germany.
  • Natural Gas Regulatory Litigation – advising and representing a Polish natural gas transmission company in a set of proceedings connected with an appointment and cooperation with an independent system operator for a natural gas pipeline.
  • Commercial Contracts – advising one of the major Polish power companies on the process of construction of a coal power plant.
  • Power Corporate Litigation – advising and representing before a common court in a matter connected with disclosure of sensitive information regarding the construction of a coal power plant.
  • Renewables Regulatory Litigation – representing an international company before the Polish energy regulator in a case concerning a refusal to interconnect a battery energy storage to a power distribution grid.

  • Power Price Limits 2022-2023 – advising an international renewable energy producer on the inclusion of revenues from a virtual power purchase agreement in electricity price limits for settlement purposes with Zarządca Rozliczeń S.A.
