Charles Smith is a consultant at Clyde & Co and specialises in marine insurance, shipping/transport litigation and dispute resolution, principally on behalf of marine cargo insurers.  Charles handles litigation before the Commercial and Admiralty Courts in London and before London Arbitration Tribunals, including the LMAA.

Charles Smith handles cases arising out of vessel casualties (including collisions, groundings, total loss sinking and engine breakdown) and high value/complex cargo damage claims.  Charles also handles a large volume of medium size cargo recovery claims for leading marine insurers, particularly in the Korean and Indian markets.

• “MARITIME MAISIE” c/w “GRAVITY HIGHWAY” [2020] – Led the UK High Court litigation relating to this 2013 marine collision case, including the first post-Civil Procedure Rules authority dealing with the test for whether a Court Order requiring a party to provide further information has been complied with - advising successful Korean hull underwriters.
• “CCNI ARAUCO” [2016] – Advising various marine cargo insurers on claims for General Average and recovery of losses in relation to this container vessel fire case.
• “ORNA” [2011] – Acting for Indian marine cargo insurers in relation to cargo loss claims relating to this Somali piracy incident.
• “YM GREEN” [2006] – Advising multiple insurers worldwide of more than 800 containers of cargo on claims for General Average and recovery of losses arising from this major container vessel fire incident.
