James is a Senior Associate in the aviation liability department with international experience representing airlines and their insurers in contentious aviation/aerospace claims in multiple different jurisdictions applying international treaties such as the Montreal Convention 1999 and/or the applicable domestic law. James manages a large caseload for several major international airlines and their insurers with a broad range of complexity, dealing with all aspects of aviation liability/insurance. Primarily focusing on defending claims brought in respect of personal injury, baggage, delay, denied boarding and cargo, damage to airport equipment and engines and claims brought against airlines for flight delay and cancellation pursuant to regulation EC261/2004. James also has experience dealing with OFAC sanctions issues and in pursuing recovery actions for (re)insureds/(re)insurers.

Experience
  • Assisting with the pursuit of successful subrogated claims for insurers (and insured’s uninsured losses) in Europe.
  • Assisting with advising (re)insurers in respect of insurance related sanctions and coverage issues/loss of aircraft arising out of Russia’s invasion of Ukraine in February 2022.
  • Assisting with advising a major Middle Eastern carrier and its (re)insurers in connection with high profile proceedings before the High Court in England concerning a spider bite and the meaning of an ‘accident’ within the purview of Article 17 of the Montreal Convention 1999.
  • Assisting with advising a major European airline in respect of damage to an engine test facility at Norwich Airport in January 2017.
  • Assisting with advising insurers/(re)insurers in respect of claim for damage to an aircraft engine during transportation between Wales and Casablanca in November 2013.
