Callum's primary focus is on contentious matters, including formal litigation and arbitration, as well as alternative dispute resolution, such as adjudication.

He has worked for a variety of clients, both domestic and international (including subcontractors, main contractors, developers and local authorities), and is familiar with a wide range of standard form contracts as well as bespoke agreements.

Callum endeavours to provide practical, pragmatic and strategic advice to help clients achieve their objectives in the most cost-effective way possible.

Experience

Residential / Commercial

  • Advising a housebuilder in relation to a litigated dispute concerning the allegedly negligent design of a heating system in a mixed-use development.
  • Acting on various fire-safety related disputes for a main contractor (including in connection with the application of the changes brought about by the Building Safety Act).
  • Advising an international fit-out contractor on means of protecting its position in relation to entitlement to additional sums and liability for delay damages.
  • Acting in an ICC Arbitration concerning the supply of materials for a landmark project in New York, working with a technical expert to establish that the quality of the materials supplied met the specifications and that the employer had wrongfully withheld payment.

Infrastructure

  • Advising an infrastructure contractor, in connection with the renewal of an underground station, on means of protecting its entitlement to additional sums and limiting its liability for liquidated damages (including a series of tactical adjudications).
  • Acting on behalf of a respondent subcontractor in an adjudication brought by the main contractor in respect of allegedly defective work undertaken as part of a motorway widening scheme.
  • Advising a local authority on potential avenues for disputing significant additional costs claimed by a utilities company relating to the renewal of an arterial road in Newcastle.
  • Acting for a respondent main contractor in an adjudication concerning an allegedly defective roof system installed at hospital (including complex issues of contract formation and limitation).

Energy

  • Working with the contractor on an offshore wind project; advising on issues of contractual interpretation, claims for EOT/prolongation and the application of liquidated damages.
  • Collaborating with Chinese co-counsel in a hybrid CIETAC/IBA arbitration connected with the construction of a powerplant in Indonesia, including a significant claim for additional time and costs.
  • Representing a client in an ICC Expert Determination related to a nuclear powerplant renewal project in Belgium and concerning high value claims and counterclaims, including delay and disputed variations; resulting in a favourable decision, including a finding on notice requirements which extinguished the majority of the subcontractor’s counterclaims.
  • Working on a high value litigated dispute concerning alleged negligence or fraud in connection with the procurement process and letting of a contract for the construction of an oil and gas facility.
