Melanie has successfully run several high profile cases to the Court of Appeal, eg. Singh v Yaqubi, Opoku v Tintas and McBride v UKI. These cases have shaped the law in credit hire to what it is today.

In addition, a number of cases have attracted the attention of the media, the most recent being the highest known value credit hire case in the country, a claim for circa £400,000 of credit hire and which was ongoing at the date of the trial. That claim was successfully defeated on liability.

Melanie regularly contributes to industry debate and is a member of the FOIL credit hire special focus team.

Experience

• Developed market leading product for handling credit hire claims in the MOJ
• Successfully defended £400,000 credit hire claim, a case which was picked up by the insurance and National Press
• Obtained Summary Judgment on a £234,000 hire claim on the basis the Claimant could not prove a need to hire, a decision which was then upheld on appeal. This case also attracted media attention.
• Worked with several insurers on a strategy to tackle repair inflation
• Identified a need for, and set up, a performing cross disciplinary team to deal with claims presented by the "one stop shop" type credit hire companies
• Worked with a leading insurer to investigate and defend suspect claims presented for additional insurance leading to a significant claim being discontinued
• Has significant experience in prosecuting and defending appeals at a high level.
