Claire is an Associate in the global Projects and Construction group with experience in both contentious and non-contentious PPP/PFI projects and construction matters. Claire acts for a range of clients including project consortia, service providers, funders, employers, developers and contractors.

Claire’s non-contentious experience includes advising on the operational aspects of PPP and PFI projects, including extensions to project facilities, changes to the provision of services, interfaces with multiple stakeholders, and the replacement of sub-contractors. She also acts for developers, drafting and negotiating various contractual documents with contractors and consultants.

On the contentious side, Claire has acted for parties using a range of dispute resolution methods, including High Court litigation, arbitration and adjudication, as well as advising on a number of pre-action construction disputes.

Experience
  • Advising a number of project companies on operational variations to hospital and housing PFI projects.
  • Advising a number of project companies on the replacement of sub-contractors on hospital and education PFI projects. 
  • Advising project companies in relation to education PFI projects on the conversion of their school portfolios from maintained schools to academies. 
  • Advising a service provider up to financial close on Irish further education PPP projects. 
  • Advising a concession company under a PFI regime on disputes relating to defects and claims against the D&C contractor. This involved drafting and negotiating a remedial works agreement, project agreement deed of variation, settlement agreement, standstill agreement and associated ancillary documents. 
  • Advising a contractor in relation to a dispute under an amended NEC3 contract with an international sub-contractor in relation to the development of a London university.
  • Advising on tender reviews including amended NEC and JCT forms, as well as bespoke contracts and identifying key risks for the client.
  • Acting for the UK arm of a major US property fund and assisting with several commercial developments, involving drafting and negotiating building contracts and demolition contracts and supporting the negotiation of the principal project level agreements with funders. 
  • Preparing construction reports for commercial tenants based on JCT standard form building contracts, appointments and collateral warranties.
  • Advising on and preparing trade contracts on different phases of a high-profile mixed-used development in Battersea.
  • Drafting and negotiating a bespoke operating contract for a local authority.
  • Advising a property developer and a local authority on glass defects arising out of both a bespoke building contract and an amended JCT building contract.
