Ouran has defended various construction parties and site participants against allegations of deficient work and property damage under Commercial General Liability and Wrap Up Liability policies.
He has prosecuted and defended subrogated claims under first party Comprehensive or Broad Form policies, and Builder’s Risk or Course of Construction policies. He has also defended professional consultants, including architects and engineers, under Professional Liability policies against allegations of professional errors or omissions.
In his practice as coverage counsel, Ouran has:
-prepared reservation of rights letters in response to claims made under CGL, D&O, E&O, course of construction, wrap-up liability, and homeowner policies;
-prepared coverage opinions where insurers have reason to believe there was a material misrepresentation, material change in risk, or breach of warranty in the context of fire or flood related losses;
-assumed conduct as second chair in a total loss coverage dispute that resolved prior to trial where issues in dispute included whether there was a material change in risk, breach of warranty, proper measurement of recovery, and relief from forfeiture.
