Pariya is a Senior Associate in the Projects and Construction team in our Sydney office since April 2022. Pariya has worked on a range of construction and infrastructure projects, including roads, rail, renewables, commercial and residential projects. 

Pariya’s experience includes project delivery and dispute resolution, including litigation, arbitration, expert determination, security of payment claims and mediation.

Prior to joining Clyde & Co, Pariya worked in a boutique law firm specialising mainly in construction in Sydney and also worked in the UK.

Experience
  • Successfully acted for an Italian design consultant against CPB Contractors in NSW Supreme Court proceedings obtaining a mandatory stay to the NSW Supreme Court proceedings and referring the dispute to arbitration - CPB Contractors Pty Ltd v DEAL S.R.L. [2021] NSWSC 820.
  • Successfully acted for Acciona Infrastructure Australia Pty Ltd in NSW Supreme Court proceedings in respect of an application to set aside an Adjudication Determination under the Building and Construction Industry Security of Payment Act 1999 (NSW) - Acciona Infrastructure Australia Pty Ltd v Holcim (Australia) Pty Ltd [2020] NSWSC 1330.
  • Successfully acted for a contractor against Canterbury-Bankstown Council in NSW Supreme Court proceedings in defending an application by the Council to permanently restrain the contractor from making an adjudication application under the Building and Construction Industry Security of Payment Act 1999 (NSW) in respect of its final payment claim - Canterbury-Bankstown Council v Payce Communities Pty Ltd [2019] NSWSC 1419.
  • Successfully acted for a contractor against Canterbury-Bankstown Council in NSW Supreme Court proceedings in defending an application by the Council to set aside an Adjudication Determination under the Building and Construction Industry Security of Payment Act 1999 (NSW) - Canterbury-Bankstown Council v Payce Communities Pty Limited [2019] NSWSC 1803.
  • Acting for the contractor in multiple expert determination against the Department of Education under GC21 Contracts concerning the redevelopment of several schools in New South Wales.
  • Successfully defending a claim in the NSW District Court and NSW Court of Appeal against its subcontractor in respect of the interpretation of the contract and whether it was of a ‘lump sum’ agreement or a ‘schedule of rates’ agreement - C & V Engineering Pty Ltd v Hamilton & Marino Builders Pty Ltd [2020] NSWCA 103.
