Clinical negligence: Acts in high-value cases including the most serious brain and spinal cord injuries and fatalities.  Wide range of experience in all aspects of clinical negligence claims acting on behalf of insurer clients, including NHS Resolution, the MDDUS and Berkshire Hathaway.

Product liability: Managing NHS claims involving product liability issues. 100% success rate in rebutting claims for defective products against a well-known international manufacturer. Experience in advising international insurers in complex direct-action claims, involving jurisdiction and choice of law issues, inter alia.  

Healthcare: Wide experience in a range of other matters, such as Data Protection Act and Human Rights claims. Advisor to medical professionals and their insurers on issues such as complaints/internal investigations, disclosure, data protection, GMC,  investigations etc. 

Experience

Andrew has successfully defended the following cases at trial: 

  • SD v (1) AR (2) JT [2024] EWHC 2444 (it was the claimant’s case that the defendants i) failed to warn her about the risk of bowel injury during an ALIF procedure; and ii) negligently injured the bowel during the procedure).  
  • Samantha De Francisci v Hampshire Hospitals NHS FT [2024] 5 WLUK 596 (an obstetric claim which examined whether aspirin prevents pre-eclampsia on the balance of probabilities)  
  • Jacqueline Beatty v Lewisham & Greenwich NHS Trust [2023] EWHC 3163 KB (a case concerning an alleged failure to diagnose embolism leading to amputation);
  • Lee Kitchen v Hillingdon Hospitals NHS Foundation Trust [2022] 5 WLUK 720 (the first secondary victim judgment after the Court of Appeal decision of Paul); 
  • Trevor Thornton v Surrey and Borders Partnership NHS Foundation Trust [2020] unreported (a mental health claim which included allegations of assault);
  • Graca Hall v East and North Hertfordshire NHS Foundation Trust [2016] EWHC 1811 (QB)(a liability only obstetric claim); and 
  • AS v East Kent Hospitals University NHS Foundation Trust [2016] EWHC 1057 QB (an ophthalmic claim in which damages had been agreed for a six figure sum).
