Nikita Damburgs

Nikita is a Senior Associate in Clyde & Co’s London office. 

He has acted for a number of high-net-worth individuals, companies, and government entities in connection with various high-value commercial disputes. Nikita has experience of representing clients party to proceedings before the High Court as well as in international arbitrations (LCIA, ICC, and ARIAS, amongst others). He has acted for clients across many different industry sectors, including aviation, financial services and investments, pharmaceuticals, technology and digital, and commodities/international trade. 

Nikita has particular expertise in civil and commercial fraud disputes and has assisted his clients with obtaining and responding to urgent interim relief, including applications for freezing, receivership, and disclosure orders.  

Nikita is fluent in Russian and has worked extensively in that language. Many of his cases involved a cross-border element and he has experience of co-ordinating work with lawyers in other jurisdictions, including the BVI, the Cayman Islands, the United Arab Emirates, Germany, Austria and Russia. 

Nikita has higher rights of audience in the civil courts and has appeared as an advocate in relation to interim applications in High Court proceedings where opposing parties were represented by experienced members of the Bar.

Experience

• Acting for a major insurance company in the so-called “Russian Aircraft Claims”, brought by lessors of aircraft under various contingent & possessed insurance policies (total value
  c. US$5 bln)
• Representing a cryptocurrency trader in High Court proceedings concerning a Bitcoin-Tezos swap contract, including appearing as an advocate on a security for costs application (opposed by a (then) QC)
• Acting for the English Department of Health in connection with a c. £200 million competition damages claim against the French pharmaceutical company Servier
• Representing a European sate in a c. €200 million dispute with a major international investment bank concerning derivates and other financial products
• Successfully obtaining a freezing injunction for a high-net-worth individual against the client’s former financial advisor, in a claim concerned with failed investments valued at c. £50 million
• Acting for a high-profile individual in contempt of court proceedings brought in relation to an alleged breach of an anti-suit injunction obtained in support of LCIA proceedings
• Representing various LLPs in connection with an application for freezing and receivership orders made under s.25 CJJA1982 in support of proceedings in Georgia and Ras Al Khaimah
• Representing a claimant in arbitration proceedings brought under a Directors’ and Officers’ insurance policy
• Representing a respondent to a freezing order obtained in support of LCIA proceedings valued at c. £100 million
