Simon has a particular focus on contentious construction law. His work has required him to advise on projects of national importance and projects across various industries, including: transport (road and rail), commercial and retail, tourism, hospitality, military, energy (conventional and renewable), natural resources, urban development and social infrastructure.

Those matters have been conducted by way of all forms of dispute resolution, including statutory adjudication, mediation, expert determination, dispute avoidance board, arbitration, litigation (first instance, appellate and final), and in both domestic and international jurisdictions.

Simon also assists on non-contentious construction matters, and regularly provides project counsel services and strategic advice in relation to project delivery issues, including those related to scope, variations, design, defects, delay and disruption.

  • Acting for a leading global construction company in an arbitration related to various claims and counterclaims, with the largest valued at AED1.7B, relating to the expansion of a mall.
  • Acting for a leading building façade company in an arbitration related to various claims and counterclaims related to the design, construction and installation of the façade on one of Qatar’s most prominent buildings.
  • Acting for a public entity in an expert determination in respect of various claims made across 26 separate areas arising out of a AUD565M federal and state funded upgrade of a major Australian motorway.
  • Advising a major publicly listed hospitality and gaming company in relation to various disputes arising out of the design and construction of its landmark AUD1B integrated hotel project.
  • Advising a state-owned rail company in relation to various complex and high value disputes, and the implementation of its AUD10B metro railway project.
  • Acting for a publicly listed main contractor in a modified dispute avoidance board procedure regarding sequential disputes arising out of a AUD1.2B upgrade of a major arterial motorway.
  • Acting for a council in disputes arising out of a multi-billon dollar urban renewal project, including major infrastructure and an aquatic centre (the largest of its kind constructed since the Sydney Olympics).
