The Kenya Robotics and Artificial Intelligence Society Bill, 2023 (“the Bill”), signifies a pivotal step forward in Kenya's journey toward technological innovation and governance. As Kenya continues to position itself as a hub for innovation in Africa, the Bill aims to establish clear guidelines and regulations for the burgeoning fields of robotics and artificial intelligence (“AI”) within the country. The enactment of this Bill aligns with the principles laid out in the Constitution of Kenya 2010, ensuring that Kenya remains at the forefront of technological advancement while safeguarding ethical standards and societal interests.

However, we note that the definitions provided in the Bill for robotics and AI are overly simplistic and lack the nuance required to capture the complexities of these fields. 

The definition of robotics simply overlooks the interdisciplinary nature of robotics, which also involves computer science, cognitive psychology and even ethics. Similarly, the definition of AI as the ability of machines to perform tasks associated with human intelligence is too broad and vague. It fails to address the various types of AI, such as narrow AI and general AI, and does not consider the ethical, social and legal implications that are critical in AI discourse. These definitions could lead to ambiguities in the application of the law and might not sufficiently guide the regulation of these technologies in a rapidly evolving landscape.

A robust framework for robotics and AI

At the heart of the Bill is the establishment of the Kenya Robotics and Artificial Intelligence Society (the Society), which will serve as the primary regulatory body overseeing all activities related to robotics and AI. Organisations that fail to register with the Society of could face fines of up to Kenya Shillings One Million (KES 1,000,000.00) (approximately $6,250) or imprisonment for up to two years or both.

The EU's framework is stringent, with a strong emphasis on ethical AI and safeguarding fundamental rights. In contrast, the U.S. takes a more decentralised approach, with AI governance primarily handled at the state level and by specific sectors, emphasising innovation and self-regulation over prescriptive rules. Kenya's Bill, with its specific definitions and regulatory structure, aligns more closely with the EU's approach in terms of scope but lacks the detailed risk-based categorisation found in the EU legislation.
