Our conversation will revolve around the question “Is it worth it?” Increasingly, global clients are asking their counsel and advisors to consider the all-in benefits, costs and risks to legal action before commencing proceedings, and are asking for this assessment to be provided in the same commercial and financial language in which businesses make other capital allocation decisions. We will discuss with Adrian and Matt the concept of the net present value (NPV) of a dispute and how this can be used with law firms and in-house legal departments to optimise legal decision-making and the management of contentious investments.
