David McElveney leads the projects & construction group in Clyde & Co’s Abu Dhabi office. He has been practicing in the UAE since 2008 and has over 25 years’ experience working on both contentious and non-contentious matters. David was, for 12 years, a partner at Deacons (now Norton Rose), a major Australian/international law firm where he headed the construction & engineering group.
David has significant experience in claims management, dispute resolution, arbitration and litigation. He as acted for the successful parties in a number of high-profile construction and engineering disputes, including some of the largest construction disputes in the GCC. In addition to dealing with the normal range of claims and disputes which arise in construction projects, some of the disputes David has been involved in have become leading authorities on issues such as the role of the project certifier (Peninsula Balmain -v- Abigroup Contractors), the right to appeal from an arbitration award (Warley -v- ADCO Constructions), the proper conduct of a an Expert Determination process (Triarno -v- Triden Contractors) and the interpretation of “consequential loss” in exclusion of liability clauses (GEC Alstom -v- Sunshine Council).
David is an accredited mediator. He has presented seminars on a range of construction law topics, including arbitration, in the UAE, Australia, Thailand and Singapore.
