Anti-money laundering

In accordance with our own risk management policies or where required by applicable anti-money laundering legislation and regulation we will verify your identity and we can accept your instructions only on the basis that you can properly identify yourself (and any persons whom you represent, including the client’s beneficial owners) to us. We may also need to raise enquiries as to the source of client assets and the source of funds to be used with each engagement. We take our obligations seriously to protect both us and our clients and if we do not receive sufficient evidence of identity within a reasonable time of our request, we reserve the right to decline your instructions.

We may also be required to make further enquiries of your identity, even after your instructions have been accepted by us and you are a client of the firm, for example where the level of risk attributable to you or your matter changes, or where we need to ensure that the information we hold remains up to date. We may need to cease acting if we do not receive, within a reasonable timeframe, sufficient additional evidence to enable us to comply with our legal and regulatory obligations and risk management policies. Where we need to cease acting for you in circumstances where you are unable or unwilling to provide us with any further evidence we require, you will be charged for, and will remain liable to pay for, any work done up until the time we cease acting.

2. UK & Ireland – Complaints

England & Wales

Clyde & Co is committed to providing the highest standard of service to its clients. If, however you have any queries or concerns, at any time, on any aspect of a matter (including a bill) then please do not hesitate to contact the person dealing with your matter in the first instance or if you prefer, the Partner responsible for supervising your matter. We will try to address any problem quickly and operate an internal complaint handling system to help us resolve the matter between ourselves. What to do if we cannot resolve your complaint

The Legal Ombudsman can help you if we are unable to resolve your complaint ourselves. They will look at your complaint independently and it will not affect how we handle your case. Before accepting a complaint for investigation, the Legal Ombudsman will check that you have tried to resolve your complaint with us first. If you have, then you must take your complaint to the Legal Ombudsman:

  • Within six months of receiving our final response to your complaint

and

  • No more than one year from the date of the act or omission being complained about; or
  • No more than one year from the date when you should reasonably have known that there was cause for complaint.

What to do if you are unhappy with our behaviour

The Solicitors Regulation Authority can help if you are concerned about our behaviour. This could be for things like dishonesty, taking or losing your money or treating you unfairly because of your age, a disability or other characteristic. Scotland

If you are unhappy in the first instance, please take this up with the person handling your case. If you remain dissatisfied, then matters should then be raised with the Partner supervising your matter. Thereafter you have the opportunity to raise the matter in writing with our Client Care Partner for Scotland. This will be handled in terms of our complaints protocol which has been submitted to the Law Society of Scotland and a copy of which is available upon request. If you continue to remain dissatisfied then you may also take matters up with the Scottish Legal Complaints Commission (SLCC), The Stamp Office, 10-14 Waterloo Place, Edinburgh, EH1 3EH. The SLCC operates within strict time limits and require complaints to be made within one year of the service ending or the conduct occurring. In considering time limits, the SLCC has a discretion to disregard any period of time if it considers that the complainer was excusably unaware of the grounds of the complaint. At any time, the SLCC will be able to provide information regarding the procedures for complaints against solicitors.  We would refer you to http://www.scottishlegalcomplaints.org.uk.

Northern Ireland

Any complaint made to us must be within six months of completion of your case or transaction or within six months of discovering a cause for concern, whichever is later. If we have not been able to resolve your complaint with our internal procedure then you can refer your complaint to The Law Society of Northern Ireland, you must do this within 6 months of our final response.

7. UK Tax Strategy Statement 

Clyde & Co LLP regards this strategy statement as complying with its duty under Finance Act 2016, Schedule 19, para. 16. This statement applies to Clyde & Co LLP and all UK affiliated entities for the financial year ended 30 April 2024 and subsequent financial periods until it is superseded.

The statement covers our approach to conducting our UK tax affairs and dealing with UK tax uncertainties and risk. It has also been approved by the Management Board of Clyde & Co who have responsibility for monitoring its application.
